(hereinafter referred to as “Hidex” and/ or “We” and/ or “Us”) and how we sell our products to you (hereinafter referred to as the “Products”). Please understand that you will be asked to consent to this Policy before ordering our Products and, consequently, if you refuse to consent, you will not be able to place your order.
Please note that we reserve the right to amend this Policy at any time at our own discretion. So please check with this Policy every time you order our Products.
- We are Hidex Ltd. – a company duly registered in England and Wales and operating under the laws of England under company number 10956963, registered office at 1 Armoury Way, SW18 1TH London, United Kingdom (UK).
- When using our site www.hidex.co.uk, we collect your personal information. Please read our Privacy Policy to understand how we collect and process that data.
- To get full information about our returns and refunds please read our Returns and refunds policy.
- We kindly ask you to review your order information carefully before placing your order as this information will be used for processing and dispatch of our Products to you. Please use our site as a guide to help you extract information about our Products as possible.
- After placing your order, We will receive an automatic email confirmation with the order number and other order information. This will mean that We accept your order and start processing it. Please note that this moment of notification is the moment the Legal Contract is entered into between Hidex and yourself.
- Please note that We reserve our right to deny our services to any customers and to request further information from you to provide our services.
- If for any reason we are unable to process your order, more specifically: some of our Products are not in stock at the moment, no longer available, the delivery date can not be met due to post offices strikes etc., we will not process your order of which you will be notified accordingly via email to the address that you indicated in the contact information provided when placing your order. In this case you will be refunded accordingly in full.
- Delivery charges are always included in the prices of our Products, unless the order requires an international shipping.
- The prices of our Products displayed on our website do not include VAT, however you can check the VAT rate added to your order when you proceed to checkout. The rate of the VAT charges is the current applicable VAT rate provided for by tax legislation in the UK at the moment of placing the order. This clause does not apply to international orders as the VAT charges for any international order are subject to the country where the Products are shipped and applied only when required under current legislation of the UK and international treaties.
- The current price of any of our Products is quoted on our website – www.hidex.co.uk. If ever and whenever an error in pricing occurs and you have already placed an order and been charged, we will notify you via email about this error and will provide you an opportunity to decide whether you want to proceed with receiving your order, and:
- if the actual price of the product is lower than the one that’s been charged – to receive a refund with a price difference to your bank account;
- if the actual price of the product is higher than the one that’s been charged – to pay us the price difference in one of the available payment methods;
- to cancel an order completely and you will be refunded in full.
- In case you have placed an order which contains an error in price but you haven’t been charged yet, we will notify you of an error using the contact information in your order and will offer you an option to pay the correct price and proceed with your order or to cancel your order.
- Please note that in case the processing of your order requires any additional instructions from you, more specifically: a pricing error, delivery address is incomplete or incorrect, stock availability of your order, or any other case that in our opinion needs to be resolved only by receiving additional instructions from you, and we are unable to reach you using the contact information you provided in your order – we will treat the order as cancelled of which we will notify you accordingly using the means of communication available.
- We reserve the right to change the prices of any of our Products from time to time at our own discretion, however these changes do not affect already processed orders.

- Hidex is not liable for any failure and/ or delay in performance of any of our services or obligations hereunder that was caused by the Out-of-Control Event as defined in clause 20 hereof.
- An Out-of-Control Event is an act or event beyond our reasonable control, the consequences of which would have been unavoidable despite all efforts to the contrary and include without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks (including without limitation power failures, mobile network failures and Internet disturbances). This would also include suspension of our services resulting from maintenance and upgrades to our systems or the systems of any party used to assist with provision of our services, outages on any phone network or in the case of mobile networks where you are not in an area of mobile coverage.
- Please note that if an Out-of-Control Event occurs:
- we will notify you within a reasonable time;
- we will reserve the right to suspend our obligations hereunder and/ or to extend the time for performance of our obligations for the duration of an Out-of-Control Event;
- in case an Out-of-Control Event concerns our delivery counterparty, we will aim to solve this situation within 10 business days by finding a new delivery agent and arranging for a new delivery date. For this purpose we will contact you using the contact details provided in your order;
- in case an Out-of-Control Event continues for more than 30 business days you may terminate this Legal Contract and request (in writing) a refund in full.
- By accepting these Terms & Conditions you agree that you purchase our Product only for domestic, private and/ or commercial use. We do not provide our consent to resale of any of our Products and are not liable for any loss of business opportunity, loss of profit, loss of business and/ or business interruption.
- We are only liable for any loss or damage you suffer from our direct breach of these Terms & Conditions. We are not liable for any loss or damage that is not contemplated by us or you at the time of execution of this Legal Contract.
- Our liability is not in any way limited or excluded by:
- any breach of the terms implied by section 13 to 15 of the Sale of Goods Act 1979;
- defective products under the Consumer Protection Act 1987;
- any breach of the terms implied by section 12 of the Sale of Goods Act 1979.
- Neither failure by Us to exercise, nor any delay by the Us in exercising, any right or remedy under this Legal Contract will constitute a waiver thereof, nor will any single or partial exercise of any right or remedy prevent any further or other exercise thereof or the exercise of any other right or remedy. We will only waive a default by you in writing, and that will not mean waiver of any of your later obligations in the future.
- If any provision of this Legal Contract will be held or deemed invalid, void, inoperative or unenforceable such circumstance shall not have the effect of rendering any other provisions herein contained invalid, void, inoperative or unenforceable. In that case Hidex will take all required measures to alter such invalid provision with the new ones, which will respond to the subject of this Legal Contract and to the interest of the parties.
- Transfer of any and all rights and obligations hereunder to any third parties are not permitted, unless the party that wants to transfer its rights and/ or obligations in part or in full obtains a written consent to do so from the counterparty.
- This Legal Contract is governed by, and construed in accordance with the laws of England. Any dispute arising hereunder shall be resolved in the competent courts of England.
